Scope

These Terms and Conditions govern the use of 2342.ai, operated by anycast.io UG (haftungsbeschränkt). By registering for or using the platform, you accept these terms.

Service

2342.ai provides a managed AI platform and AI gateway with a workspace, API access, team controls, model routing, budget logic, prompt library, research functions, file storage and vector stores.

2342.ai does not sell, license or broker direct access to third-party accounts, provider quotas, third-party API keys or third-party infrastructure. Customers receive access to the 2342.ai platform. Third-party models may be used as technical infrastructure components and subprocessors for selected platform functions.

API compatibility and platform endpoints

API compatibility is provided to simplify technical integration. The endpoints are 2342.ai platform endpoints and are subject to 2342.ai model choice, budget checks, usage recording and rate limits.

An OpenAI-style or Anthropic-style API does not mean that a direct provider account, a specific provider endpoint or a specific provider availability is owed.

Registration and use

A user account with a valid email address is required. Access credentials, API keys and sessions must be kept confidential.

You may not use the platform for unlawful content, spam, abusive automation or to circumvent third-party terms of use.

Pricing and budget logic

The platform uses plans and usage-based billing. Included budget and any usage beyond it are governed by the booked plan and the applicable terms.

Where team functions are used, consumption may be charged against a shared team or organization budget.

The monthly budget is the usage volume included in the booked plan for the respective billing period. It is made available again in the booked amount with each renewal. Unused monthly budget remains usable beyond the end of the billing period until twelve months after its start, including after the plan is cancelled, and expires afterwards. Monthly budget is not refunded.

Extra credit is usage credit purchased separately. It does not expire, including when the plan is cancelled. Usage is charged against the oldest available monthly budget first, then against more recent monthly budget, and against extra credit last.

Monthly budget and extra credit can only be used for 2342.ai services within the respective organization. They are not e-money or a means of payment, bear no interest, cannot be transferred to third parties or other organizations, and are not paid out during the term of the contract.

2342.ai usage credit covers routed model execution, gateway processing, rule checks, measurement and provider costs.

For selected business customers, 2342.ai may enable monthly post-pay invoicing after prior approval. Post-pay is not generally available as of right and requires separate activation for the relevant organization account.

Post-pay, payment due date and suspension

For business customers enabled for post-pay, usage-based charges are generally invoiced after the billing period. Invoices are due immediately upon receipt unless the invoice states a different due date.

Where offered, payment is made using the method stated on the invoice, in particular by bank transfer through the payment service provider used for the invoice.

2342.ai may grant post-pay customers a monthly usage limit. That limit is automatically increased only if the preceding invoice was paid in full within seven calendar days of the invoice date. If payment is late or incomplete, the limit remains unchanged or may be reduced.

If an invoice remains unpaid for fourteen calendar days after its date, 2342.ai may suspend the affected organization account and related usage until all outstanding amounts are paid. Statutory rights and default consequences remain unaffected.

Ad videos

Ad videos are the guided creation of advertising material from the customer's inputs (website address, texts, uploaded logos, photos and references) with AI-generated texts, images, clips, synthetic speech and automated cuts. Every step that incurs cost shows its price before it runs; it is charged against the organization's budget like other usage.

The brand profile is derived from publicly available sources about the customer's company and from the customer's inputs. The customer reviews and confirms it before it is used.

The customer may use generated material for its own advertising without limitation in time or territory, to the extent 2342.ai can grant such rights. AI-generated images, clips and voices are not unique; similar results may be generated for other customers, and no exclusivity is granted. Voices are synthetic stock voices; 2342.ai does not clone real voices.

The customer is responsible for the material it uploads and for the content of the finished video: in particular for rights in logos, photos and texts, for the accuracy of advertising claims, prices and comparisons, and for compliance with advertising, trademark, competition and consumer law. Uploads showing recognizable people require a lawful basis on the customer's side; 2342.ai marks such uploads and keeps them on the EU data path.

Generated material is AI-generated. The customer labels it where the law requires, in particular under the transparency obligations of the EU AI Act. 2342.ai embeds technical provenance information where the formats allow it.

Generated material is stored in the customer's project and is deleted with it. The section on pricing and budget logic applies to all charges.

Security and abliterated models

Security and abliterated models are models with restricted or removed content filters for security testing. They are available only through the API and only to organizations whose admin has enabled external models.

The customer uses these models exclusively for its own systems or for systems whose testing the authorized party has permitted, in particular commissioned penetration tests, security audits, red team exercises, vulnerability research within published programs and training in its own test environments. The customer stays within the agreed scope and provides evidence of the permission on request.

In particular, attacks on third-party systems without permission, developing or distributing malware to harm third parties, denial-of-service attacks, obtaining or using third-party credentials outside a permitted test and any use to prepare or commit criminal offenses are prohibited.

These models are processed in Norway, Iceland and the United States and are not intended for personal data. For content containing personal data, the customer uses models with an EU data path; the data processing agreement applies otherwise.

If there is reasonable suspicion of use contrary to this section, 2342.ai may suspend access to these models or the affected organization account. The customer indemnifies 2342.ai against third-party claims arising from use contrary to this section for which the customer is responsible.

Availability and third parties

We aim to operate the platform reliably. We cannot warrant outages, response times or model changes of external AI providers.

Liability

We are liable in accordance with statutory law for intent and gross negligence. Users are responsible for professionally reviewing and deciding how to use AI-generated content.

Termination and final provisions

Accounts and active plans may be terminated in accordance with the agreed term. German law applies. To the extent legally permissible, the place of jurisdiction is Fürth, Germany.

When the contract ends, unused extra credit is refunded on request. The request can be made informally using the contact details in the imprint. An organization with unused extra credit can only be deleted after the refund.

If any provision is invalid, the remaining provisions remain effective.
